Terms of Service and Privacy Policy
Preamble
This preamble is not intended to reflect any sort of guarantee, but merely attests to our awareness and efforts regarding your privacy and security.
Primd Cooperative makes sincere efforts to protect all user's privacy, security, and safety. Through the use of encryption, both in transit and at rest, we make due attempts to ensure your personal information stays personal. Primd Cooperative will never intentionally disclose your personal information to any third-party for any purpose other than as needed to provide you with our tools and services as advertised.
The tools and services we provide make extensive use of free and open-source software solutions which are hosted on systems provided and secured by third-party cloud providers. As these solutions are deployed and maintained by Primd Cooperative, third-party providers do not have immediate direct access to this information as may be the case with other software or platform as a service systems. Nevertheless, such third-party providers retain some virtual and definite physical access to the systems on which these solutions are deployed. Examples of solutions which we deploy and manage directly include database and file storage systems, email and email list storage, as well as our internal document storage and communication (video conference calling, chats, etc) systems.
In limited instances where there is no viable alternative, Primd Cooperative may employ some third-party software or platform as a service solutions. Examples of this include, but are not limited to: phone and text message systems, some generative AI functions, as well as outbound email transmissions. In these instances, there is some limited risk of such disclosures. For example, if you provide personal information over the phone, via text message, or in general descriptive fields used in LLM contexts, this can and will result in corresponding third-party providers having that information transmitted to or through their services.
You can mitigiate these risks by providing more limited information in certain types of communications and ensuring to never mention personal information outside of dedicated fields intended to store such data (e.g. First Name, Last Name). Email transmissions, by necessity, need to include your email address, and may additionally include your name or other information. Traditionally, email transmission and relay systems (unlike storage) do not and should not retain this data for extensive periods of time, however, be advised that we do not have authoritative insight into all third-party provider's internal practices.
With more support and funding, Primd Cooperative aims to augment or replace such third-party solutions with one's we manage directly and/or to purchase services which would conform more strictly to our data privacy standards. For example, replacing external generative AI systems with our own hosted models would limit potential for disclosures as well as enable us to provide more personalized context, resulting in better service, while still preventing disclosure.
The aforementioned preamble to what follows aims to provide fair notice and transparency. In the larger context of technology companies and service providers, we are confident the tools and services we provide, as well as how we provide them, exceeds industry standards.
Warranty and Use
Primd Cooperative and its tools (Primd App and Primd Hub) as well as any additional services provided do not carry any warranty unless otherwise explicitly stated. You, as a user of the aforementioned tools or services, assume all risk related to their use including but not limited to inadvertant disclosure of personal information due to security breaches, loss of data for any reason, potential exposure to unwanted or offensive materials. Primd Cooperative will make best-effort attempts to limit and reduce such risks as well as to notify users of any such occurances.
By continuing to use our tools and services you agree to hold Primd Cooperative free from any liability (including financial) in the event of any aforementioned occurances.
Use of our tools and services is limited to individuals and organizations which operate in good faith and employ them for their intended purposes. Primd Cooperative reserves the right to decline access to tools or cancel services to any and all individuals and organizations at any time we suspect any of the following:
- Attempts to violate other users' privacy or safety.
- Attempts to disable or otherwise disrupt service for other users.
- Use of tools or services in service of illegal or illicit activities.
Primd Cooperative may disclose Personal Data and other information as follows:
As independent product or service: We will not share your Personal Data or other individual information as a product or service to any third-party. Personal Data or other individual information may be used in the production of aggregate data (e.g. regional labor force statistics) which may be sold as independent products or services or publicly distributed.
Affiliate sale or marketing campaigns: We will not share your Personal Data or other individual information with our affiliates for the purposes of selling or advertising to you. Personal Data or other information may be used in our tools and services to provide or suggest affiliate products or services only with implied (e.g. you are trying to find a training provider to learn a new skill) or explicit consent (e.g. show me ads for "books about technology" to help support Primd).
Legal Inquiries and Law Enforcement: In accordance with US and international law, we may disclose Personal Data and other information, upon subpoena, to assist in criminal law enforcement proceedings or in accordance with our own legal proceedings where applicable.
Third Parties That Help Provide the Messaging Service: We will not share your opt-in to an SMS short code campaign with a third party for purposes unrelated to supporting you in connection with that campaign. We may share your Personal Data with third parties that help us provide the messaging service, including, but not limited to, platform providers, phone companies, and other vendors who assist us in the delivery of text messages.
Additional Disclosures: Affiliates: We may disclose the Personal Data to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your Personal Data will be subject to this Policy. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
